Q. Tell us about yourself and your practice?

 

A. Q. What constitutes as Personal Injury under San Diego law?

 

A. Personal injury is a generic term that refers to cases where a person is hurt as a result of the unintentional or even intentional act of another.  Additionally, California has a strict liability statute for dog attacks that imposes responsibility for the attack on the owner of the dog.

 

Q. What are the processes to follow in filing a Personal Injury claim?

 

A. A person that has been injured should immediately seek legal assistance.  Early investigation of the matter is important.  The police and even your own insurance company will not do a thorough investigation.  Additionally, an individual should NEVER sign a release allowing an insurance company to obtain the personal private medical records and employment information of the injured party, except through your own attorney.  Further do not make any statements to anyone representing the other individuals, without advice and consent of your own attorney.

 

Q. What should a person do if she/he is sued for a Personal Injury claim?

 

A. If you are involved in an incident that causes injury to another person, you should immediately report the incident to your own automobile and/or homeowner’s or renter’s insurance company.

A. Q. What is covered under San Diego Personal Injury Law?

 

A. When a person is injured by the wrongful act (e.g. negligence) of another the law tries to make the injured party whole.  Unfortunately, we can’t turn back time and make the incident not happen; thus the only available means to make the innocent injured party whole and compensate them for the detrimental impact the incident has had on their life is by a money judgment or settlement.  Thus, an injured party is entitled to recover their economic damages which include but are not limited to medical bills, lost earnings, loss of future earning capacity and future medical bills.  Additionally, the injured party is entitled to recover their non-economic damages, including but not limited to pain and suffering, loss of the care, comfort and society of another person and emotional distress.  In certain instances punitive damages may also be recovered, when the act was intentional or done with a conscious disregard of the rights of others.  Sometimes a person injured because of a drunk driver can recover punitive damages from the drunk driver.
