Q. Tell us about yourself and your practice.
A. After earning a law degree from the University of North Carolina School of Law, Chapel Hill, in 1977, and being admitted into the North Carolina State Bar, I opened Richard A. Peniston and Associates, P.A. Over the past 32 years, the firm has expanded to include three office locations representing people state-wide in cases involving personal injury. We also serve persons injured in South Carolina. Our clients have included people from many other states and foreign countries. We regularly serve Spanish and Russian speaking clients and have translators for other languages available.
This practice is dedicated to helping injured clients receive the compensation they are legally entitled to. The firm’s practice is limited to personal injury; including automobile accidents, medical malpractice, wrongful death, and workers compensation claims. The firm is also experienced in Social Security Disability cases. We also handle criminal cases, such as speeding tickets, driving while impaired violations, misdemeanors, and some felony charges. Q. Do you offer free consultations?
A. Yes.
Q. Do you accept any of the pre-paid “legal plans” that are offered to help with legal fees?
A. No.
Q. Does your office offer paralegal services for simple forms and filings?
A. No.
Q. Do you always pay the expenses up front?
A. Frequently the firm will advance the expenses of litigation as permitted by the State Bar and determined on a case-by-case basis.
Q. How soon should one file a lawsuit?
A. It really depends upon the type of case and the seriousness of the injury, but, it is essential that measures be taken promptly in order to file a lawsuit prior to the deadline imposed by the statute of limitations. If a lawsuit is not brought within the time limit that applies to the case, the right to sue and recover damages is forever lost.
Q. Does one need to hire a personal injury lawyer in their city or town?
A. It is not necessary to hire an attorney in the same town or city. Generally, a person bringing a personal injury action would want to hire an attorney licensed in the state they live in. We have attorneys licensed in both North and South Carolina.
Q. Is there any time limit to file a personal injury lawsuit in Charlotte?
A. Different types of personal injury cases have different time limitations. Generally, personal injury lawsuits must be filed within three years from the date of the injury. However, wrongful death claims normally must be brought within two years from the time of death, and there are some other variations to the general three year limitation.
Q. Can a person recover damages for injuries sustained on someone else’s property?
A. Yes, and we represent many clients in “Slip and Fall” or Premises Liability cases. In North and South Carolina it is still necessary to establish the negligence of the property owner.
