Q. Tell us about yourself and your practice.
A. I have been practicing family law for about 30 years. My son David is also a family law attorney working with me. He has been an attorney for about 2 years.
Q. What are the main services you provide?
A. For the most part, all areas of family law.
Q. What, under Bakersfield law, constitute as divorce?
A. There is nothing such as Bakersfield law, there is only the California Family Code. You do not need a reason for a divorce in California. All you have to say is that there are "irreconcilable difference" between the parties. No explanation is necessary.
Q. How long does it take to process a divorce?
A. It takes 6 months in California to be divorced. But, in some cases the parties are in court fighting over kids and money a long time after the 6 months have gone by.
Q. What happens when I engage your services?
A. I will analyze your case and suggest a game plan as to what we file and when we file it (including orders for protection, custody, possession of the residence and other property).
Q. Is there a relationship between seeing the children and payment of child support?
A. Yes, the amount of time either parent spends with their children is considered to be an important variable in setting the proper amount of support (child support). Spousal support is different and generally a court will consider the factors set forth in Family Code S. 4320 in setting spousal support.
Q. How does one file a divorce?
A. We file a Petition for Dissolution along with a Summons. The court in Ca charges a $350.00 filing fee.
Q. Can both parties use the same lawyer?
A. Generally, not a good idea since an attorney can not "represent both parties". If the parties have an agreement, the attorney still represents one party, but can prepare the agreement for both to sign.
Q. Can alimony agreements be changed in light of the current situation?
A. Yes, unless the parties agree to non-modifiable support, as to the amount and duration and then it would be much more difficult.
